According to this regulation, data processing must be based upon principles of honesty, lawfulness and transparency, and must protect the person against any issue concerning individual privacy and personal rights.

1. Personal data obtained from you will be processed for the purposes concerning your accommodation and other services supplied by us. 2. Processing will be carried out in the following modalities: manual and computerised. 3. Provision of personal information is compulsory and any refusal to do so could entail the impossibility to carry out procedures required for this assignment. 4. It will be possible to exercise your rights at any moment towards the data controller, according to section 7 of the Legislative Decree n. 196/2003, which is reproduced in full for your convenience:
Legislative Decree n.196/2003, Section. 7 – Right to access personal data and other rights
1. The person involved has the right to obtain confirmation of the existence of his/her personal data, regardless of their being already recorded, and communication of such data in intelligible form.
2. The person involved has the right to obtain information regarding:
a) the source of his/her personal data;
b) the purposes and modalities of processing;
c) applied logic when processing by electronic means;
d) of the identification data concerning data controller, data processors and their representative designated as per Section 5(2);
e) of the entities or categories of entity to whom or which the personal data may be communicated and who or which may get to know said data in their capacity as designated representative(s) in the State’s territory, data processor(s) or person(s) in charge of the processing
3. The person involved has the right to obtain:
a) updating, rectification or, when interested, integration of said data;
b) cancellation, anonymity or blocking of data that has been processed unlawfully, including data whose retention is unnecessary for the purposes for which they have been collected or subsequently processed;
c) certification to the effect that the operations as per letters a) and b) have been notified, as also related to their contents, to the entities to whom or which the data was communicated or diffused, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right under protection.
4. The person involved has the right to object, in whole or in part:
a) on legitimate grounds, to the processing of personal data concerning him/her, even though they are relevant to the purpose of the collection;
b) to the processing of personal data concerning him/her, when it is carried out for advertising purposes or direct sales or for market research or commercial surveys.
EasyHomes - General Contract Conditions
Terms and Conditions
The General Contract Conditions reported below regulate the applicable terms and conditions, according to the Legislative Decree 206/2005, Section 50 and ff of the Italian Civil Code, for the contract stipulated between the Client and easyhomes s.a.s. of Anna Rotti & C. (indicated as “easyhomes” subsequently) for transitory reasons and having as object the property chosen by the Client on the internet site www.easyhomes.it.
The object of this contract is the use or temporary use of a real estate rental unit, as well as the provision of easyhomes, of extra services such as hotels and non.
2.1 Property Selection. The Client can request information regarding the availability and price of the selected Property by email using the specific form that can be found on the website in the section called: “Contact and Reservations”.
2.2. Reservation Procedures. If the request of the Client and the offer of easyhomes correspond, the latter will send the Client a Reservation Confirmation with the contract proposal having the selected property as object, specifying the address, the rental period, the rental amount, the down-payment, the security deposit and any eventual additional costs (Art. 3.1.), as well as the number of tenants. In acceptance, the Client must pay the down-payment and send the proof of payment together with Passports copies to easyhomes within 3 days. If the Confirmation of Reservation isn’t returned to easyhomes within the indicated time limit, it will no longer be considered valid.
2.3. Contract stipulation. The Contract will be considered stipulated as soon as easyhomes receives the Confirmation of Reservation,(eventually duly filled in with missing Client’s details) and the payment of the relative costs of the Right to Reserve (or proof of payment).
3.Costs and payment
3.1. The Total Cost, found in the Confirmation of Reservation, corresponds to the total cost related to the whole rental period of the property or to the agreed monthly rental cost (30 days). The Down-payment corresponds to an anticipated payment on the total cost and must be paid when Reserving, by bank transfer or by Paypal, and a copy of the payment must be sent to easyhomes with the copy of the identification papers of the tenants. The Balance corresponds to the difference between the two and must be paid fully 7 days before the beginning of the rental period or on the same day (when paid in cash). Extra Costs refer to our optional services, such as planned cleaning, change of sheets, activities described in the following Art. 8.3 and 8.5, and access to Internet. These services are subject to 22% IVA (Tax). The Client must deliver the payment of the relative Property in the terms and conditions agreed upon in the Confirmation of Reservation. In the case of a rental lasting longer than one month, the payment of the following month must be delivered 7 days before the beginning of the next rental month.
It is understood that, unless stated otherwise in the Confirmation of Reservation, this rental cost must be understood as inclusive of initial and final cleaning (with the exception of that which is stated in the following Art. 8. and ff) and the costs relative to electricity, gas, heating and water.
3.2. In the case of monthly rental (30 days) or more, the costs of electricity and gas are agreed upon as follows:
Studio flat: Euro 50,00/month
Two room flat: Euro 75,00/month
Three room flat: Euro 100,00/month
Four room flat: Euro 125,00/month
In the case of a rental period shorter than 30 days, these costs are to be considered included in the rental payment. Eventual different costs related to specific properties will be communicated to the Client by easyhomes and specified in the Confirmation of Reservation.
3.3. In the case of late payment, easyhomes has the right to ask an external Debt Recovery Company or retain chosen counsel, to carry out the legal action needed to recuperate rental payments and eventually request a court order. The costs of all legal procedures will also be paid by the Client.
3.4. In the case of a rental longer than 29 days, the eventual registration costs of the contract will be divided as such: 50% to be paid by easyhomes and 50% by the Client.
3.5. At the moment of the Reservation a voucher will be sent to the Client containing all the specifications and procedures of the reservation. The Client must then print out the voucher and show it when checking-in.
4. Down payment
The Client must deliver the down payment, non- interest bearing for the Client, at the same time as the Total Balance Payment is delivered, according to the Terms and Conditions specified in the Confirmation of Reservation. This down payment will be returned to the Client by easyhomes, within 5 working days of the end of the rental Contract, by bank transfer (even if the Client paid cash/cheque, unless agreed differently between the Parties) with prior communication of Client bank details, exception made for eventual deductions mentioned earlier in Art. 3.1 and further in Art. 8 and ff, as well as for any other amount of any kind, of which easyhomes is in credit. It remains understood that in these cases or in the case of any damage caused by the Client, easyhomes will have the right to retain part of or the whole amount of the down-payment, and will return the balance as soon as the owner of the rental property and/or suppliers offer the exact evaluation of the damage and/or of the accrued credit. If the amount of the down-payment should not be high enough, the Client must commit to deliver payment of the full amount within 5 days of the notification, according to the arrangements made with easyhomes and/or described in the Confirmation of Reservation. Otherwise, easyhomes has the right to ask an external Debt Recovery Company or retain chosen counsel, to carry out the legal action needed to recuperate the credit, the legal costs of which will also be paid by the Client.
4.1. Upon delivery of the rental property, the Client and easyhomes, after having examined the property and found it satisfactory and its equipment complete, will both sign the Check-In Document and the list of relative equipment. Any complaint or discovery of damage, not seen at the moment of the Check-In, must be communicated within 24 hours of arrival in the apartment.
4.2. In the case of loss of keys, easyhomes will bill the cost of remaking the keys to the Client, which may vary between 100,00 Euro and 300,00 Euro and even more, depending on the type of key, coded or special, as well as the eventual need to change the locks of common parts of the building.
5. Duration, Termination, Extension and Cancellation of the Reservation
5.1. The length of the contract is indicated in the Confirmation of Reservation. An eventual termination of the rental contract of the property must be made in writing, by mail, fax or email, and will not be followed by any refund of that which has already been received by easyhomes, except for eventual different agreements between the Parties.
5.2. In the event of a termination of the Reservation before the first day of effectiveness of the contract, easyhomes has the right to withhold the whole amount received at the time of the Reservation, for termination costs, unless previously arranged; in the event of a termination of the Reservation with advance notice of 48 hours or less, before the effectiveness of the contract, easyhomes has the right to withhold the whole amount of the Total Cost of the rental period (even if the Client hasn’t yet paid), for termination costs.
6. Replacement of property
easyhomes reserves the right to replace the property at any time, before or during the rental period, with another property of the same value or more, if because of circumstances beyond their control or for any other reason, the Company is no longer able to ensure the Client’s stay in the chosen Property. If the Client, for reasonable and proven reasons, should refuse the Exchange of properties, easyhomes will refund the Client of the received funds. easyhomes will not pay any other amount to the Client, for any reason.
7. Arrival and departure
7.1. The keys of the Property will be given to the Client by easyhomes personnel, in the place and time previously agreed upon, between 9am and 6pm. The Client must immediately give notice of any eventual delay to easyhomes and their personnel in charge of the property. Large delays or delays without notice and check in/out not within office hours (from Monday to Friday, from 9 am to 6pm) and on holidays will add an extra cost based on the following:

At the moment of the delivery of the keys of the property, the person in charge representing our Company, will give the Client a form that contains a brief description of the state in which the property is, the relevant area, attached structures and of the contents found there, at that date. The Client agrees to sign the above mentioned form, with the right to point out, in writing, any eventual observation. In the event that the Client should not be able to move into the property on the day of effectiveness of the contract (delays, transportation strikes, personal reasons, etc.) he will have no right to a refund from easyhomes. The determinations of this clause are applied to the release of the Property as well (including eventual anticipated departures before the end of the contract).
8. Client obligations
8.1. The Client commits to not allowing the continuing stay of a number of people superior to and/or different from that which was declared in the Confirmation of Reservation. The non-fulfilment of this obligation will determine the application, in favour of easyhomes, of a penalty equal to 30% of the total rental cost of the property for each added and/or different person than those declared, with the possibility for easyhomes to decide not to allow their stay in the above mentioned property. At the moment of the reservation the Client must provide the personal identification of all the people over 18, who intend to stay in the property, by fax or email.
8.2. The client declares expressly that each person who co-habits/is employed, will be present in Italy in a regularly declared way, being an Italian citizen or, in the case of a foreigner, in compliance with regulations concerning public security (eventual visa or resident permit) assuming direct responsibility for each document needed to become compliant with current regulations.
8.3. The Client commits to using the property with care, keeping it clean and in perfect conditions, refraining from any action that could cause damage to the property and/or its relevant areas and/or attached structures and/or the goods contained in it. In the case of contracts lasting at least 30 days, the Client commits to authorising (according to that which is declared in the following Art. 9) persons, assigned by easyhomes, to inspect the conditions of the property periodically. In the event in which Client negligence is encountered, concerning the use and management of the property, of its conditions and cleanliness, easyhomes will organise the necessary actions, giving previous notice to the Client and adding the relative costs to the Client’s bill (or detaining it from the down-payment, according to previous Art. 4).
8.4. The Client commits to using the property according to all the rules and regulations of the Condominium and proper rules of neighbourhood. It is forbidden to use the property for illegal purposes or prostitution.
8.5. The Client commits to, leaving the property in the same conditions as which it was found, at the end of the rental period, and also to:
a) wash the dishes and kitchen equipment;
b) empty the refrigerator/freezer of any food;
c) throw out the garbage in the correct provided containers, in compliance with the current regulations concerning garbage disposal.
In the event of a failure to observe even only one of the previous activities of the letters a), b) and c), an Extra Cost of 40,00 euro + I.V.A. will be withheld from the Down-payment (Art.4).
8.6. The Client also commits to return the keys of the property, according to the agreements taken with easyhomes.
8.7. The Client commits to non-reproducing and/or supplying third parties with a copy of the keys to the property and/or revealing the eventual access codes to third parties. The loss of the keys or damage to the lock will entail the cost of a new lock and of 5 sets of keys.
8.8. The Client commits to observing common security measures to prevent the entry of strangers in the property and the protection of the property from outside weather events, for the whole period of the use of the property, as described in the Confirmation of Reservation. It is agreed that in the case of any failure to follow these obligations, the Client will be responsible of any eventual damage caused to the property and/or goods contained within.
9. Access to the Property.
The person entrusted by easyhomes and/or third parties authorised by the above, who can be identified on request of the Client, will have the right to have access to the Property to carry out any repair and/or maintenance work and/or verification needed to show the Property to third parties. The Client will have advance notice, unless there is an Emergency. The Client also commits to authorising visits of the Property, up to a maximum of 4 hours per week, if the Property is put up for sale by the owner.
Unless expressly authorised in written form by easyhomes, it is forbidden to the Client to house animals of any species in the Property. easyhomes reserves the right to conclude the contract at any moment and to claim for any damage, should the Client choose to house any kind of animal, causing a disturbance to the neighbours and/or damage to the furniture of the Property. In this case, easyhomes reserves the right to withhold the payments already received, as a penalty.
11. Interruption of Utilities
easyhomes will not be held responsible, towards the Client, for any eventual interruption and/or cut off, of electric power and/or gas and/or water supply and/or telephone/internet service and/or Satellite/Digital Terrestrial TV of which they are not responsible.
12. Limits of Responsibility
It is understood that, within Legal limits, the amount of eventual damage easyhomes can refund the Client, in relation to the Contract, cannot be above the amount actually received from the Client by easyhomes, concerning the Contract itself.
13. Expressed resolution clause
13.1. easyhomes has the right to resolve the Contract, in written form, in any moment and with the validity of the communication, to be delivered to the Client by hand, or by email/fax in the following situations:
a) in the case of non-payment of the amount due for, depending on the case, of a percentage (down-payment) or of the total amount of the property rental, in the delay agreed upon and conditions foreseen in the Confirmation of Reservation or
b) in the case of non-payment, by the Client, of the balance of the rental cost of the Property in the delay and conditions agreed upon in the Confirmation of Reservation,
c) in the case of non-payment, by the Client, of the security deposit indicated in the Confirmation of Reservation, in the delay and conditions stated within it,
d) in the event of behaviour which is considered contrary to good management of the Property (see Art. 8) or
e) in the case of housing any kind of animal (see Art. 10).
13.2. In the presence of provisions found in previous letters b) and c), easyhomes has the right to withhold, as a penalty, the percentage (down-payment) of the relative cost of the Property, previously received from the Client, according to that which is stated in the Confirmation of Reservation.
14. Theft or damage
easyhomes will not be held responsible for eventual theft, with or without break-in or tampering, or damage to Client belongings, or to the other co-habitants of the Property, or to third party property.
15. Applicable Law and Competent Court
The present General Contract Conditions and the Contract are subject to the laws of Italy. All disputes that may arise between the Client and easyhomes, in relation to the Contract, will be subject to the exclusive jurisdiction of the Court of Milan.
